Guide to Shellfish Aquaculture Permits in Washington
Tribal Section 6.3 and Tribal Harvest Management Plan
There are multiple times in the permitting process that the tribes are notified about a proposed project. Washington shellfish growers must provide notice to the tribes for any proposal creating artificial shellfish beds or enhancing existing natural beds on any tidelands not covered by the 2007 Settlement Agreement. If there are natural shellfish beds on your proposed farm location, you must create a harvest management agreement with the appropriate tribe(s).
Enhancements on private tidelands not covered under the Settlement Agreement require the filing of a Section 6.3 notice. Farmers can submit this Growers Notice of Intent Form to the Washington Department of Health with their harvest site application or send it directly to the tribes.

Proceed to Step 7 if your site is on public land or Step 8 if your site is on private land.
